2. General Information about processing of personal information/data
While using our website, you create and transmit certain personal information/data to us. This data will be processed and kept under strict regulations and only be processed for purposes mentioned below.
a) Extend of processing personal data
Sivali – Juergen Polte GbR processes personal data in principle for the purpose of fulfilling our contract with you and providing you with the quality of service we strive to provide. This includes processing of inquiries, customer service and maintaining a smooth operating website.
The processing of your personal data happens in general after your approval. Exceptions are when previous collection of an approval is not possible or when the processing is legally allowed.
b) Legal basis for the processing of personal data
In case we collect your approval beforehand, Art. 6/1 lit a GDPR is the legal basis.
For fulfilling a contract Art. 6/1 lit b GDPR is the legal basis. This includes activities necessary for pre-contractual communication.
If the processing of personal data is necessary to fulfil a legal obligation Art. 6/1 lit c GDPR is the legal basis.
In case life threatening interests of an affected person is at risk, Art. 6/1 lit d GDPR is the legal basis for processing of personal data.
Is the processing of personal data in the legitimate interest of our company or a third person, and the measures do not outweigh the interests, fundamental rights and fundamental freedoms of the affected person, then Art. 6/1 lit e GDPR is the legal basis for processing of personal data.
c. Revocation and deletion of personal information
The personal information of a client will be deleted or blocked, when the purpose of keeping them expires. Keeping them can be extended, if finance and tax related obligations require this.
d. Right of data portability
You have the right to have your personal information, which we process, based on your approval or in fulfilment of a contract, automatically delivered to yourself or to a third party in a standard, machine-readable format. The legal basis is Art. 6/1 lit. a GDPR or Art. 9/2 lit. a GDPR or, in case of a contract, Art. 6/1 lit. b GDPR.
If you require the direct transfer of data to another responsible party, this will only be done to the extent technically feasible.
e) Your rights in your personal information
At any time you have the right to ask information about your stored personal information, the way they were acquired and the reason why have them. You also have the right of revocation, correction and deletion of your personal information (Art. 15-20 GDPR).
Herewith you are informed of your right of complain at the relevant authorities (Art. 77 GDPR)
3. Website and log files
a) Description of data processing
Every time you use our website, the system collects data and information from your device automatically.
Following data will be collected:
information about browser type and version
operating system of the user
internet-service provider or ip address of user
date and time of use
websites through which the user came to our site
pages the user opened
These data will be saved in the log files of our website. These data will not be saved together with other personal information of the user.
b) The legal basis
for the temporary storing of this data and the logfiles is Art. 6/1 lit. f GDPR.
c) Purpose of data processing
The temporary storing of the ip address by the system is necessary to ensure the delivery of the pages on to the user's device. The ip address will be saved for the duration of the visit (Art. 6/1 lit. f GDPR).
d) Duration of storage
The data will be deleted, as soon as they are not necessary anymore for the reason for acquiring them. In case the data were acquired to ensure delivery of the web pages, they will be deleted, when the session is finished.
e) Access of personal information by third party
In theory the host of the website is able to access the data. Our website is hosted by Strato AG, Pascalstr. 10, 10587 Berlin, and we have an order-processing contract with Strato AG to protect your data (Art. 28 GDPR).
4. Contact form and email contact
a) description and extend of data processing
On our website we have a contact form, which can be used for electronic communication.
During use of this form and contact only personal information are required, which are necessary for the processing of your inquiry.
These personal information are:

Phone number
Email address
Reason of contact
While sending the contact form following data will be transmittd as well:
user's IP address, whih we do not use
date and time of registration

During the process of filling in the form, your approval for the processing of your personal information will be required and you have to notice this privacy policy.
Alternatively a contact through the mentioned email address is possible. In this case the personal information transmitted by the email will be stored.
In this context no personl information will be passed on to a third party.
b) Legal basis for the data processing
If the user's approval is given, Art. 6/1 lit. a GDPR is the legal basis.
In case the data have been sent by email, the legal basis is Art. 6/1 lit. f GDPR
If the email contact aims a preparing a contract, Art. 6/1 lit. b GDPR serves as a legal basis as well.
c) Purpose of processing personal information
The processing of personal data on the contact form serves only to process client's inquiries. In case the inquiry was sent by email, the processing of personal information constitutes a required lawful interest.
Other personal information taken during the process of sending, serves a secure transmission and prevents the misuse of the contact form.
d) Duration of storage
The personal information will be deleted as soon as they are not needed anymore for the reason of saving them. For personal information transmitted by the contact form or b email, this will be the case when the conversation with the client is terminated. The conversation is terminated, when circumstances show, that the client is not interested in travel anymore.
Other data collected during the sending process will be deleted after 7 days.
e) Revocation and deletion of personal information
At any time the user can revoke the approval for processing of the personal information. In case the contact was done by email, the user can revoke the processing at any time as well. A short message by email to us is sufficient.
In this case the conversation can not continue. All personal information will be deleted.
5. Transfer of personal information outside the EU (European Union)
After booking a trip to Asia, we may process (or ask or permit a third party to process) your personal information outside of the European Economic Area (EEA), where local laws may not provide legal protection for your information in the same way as is applicable in the EU.
We will need to provide your information to local accommodation or service providers. In other cases, we may need to share your information with an overseas service provider such as our local partners who host you during your journey or with the provider of boat or train journey.
Whenever we send (or permit a third party to send) your personal data outside of the EU, we will make sure that we take steps necessary to protect your data as required by applicable laws. For example, we will make sure that the information that we give to them will be limited to what is needed to perform our contract with you.
The personal data that we collect from you will also be processed by staff operating outside the EU who work for us or for one of our suppliers. This includes staff involved in, among other things, providing support services.

On our website you have the possibility to register for a free newsletter.
During the registration following personal information will be transferred to us:

The legal basis for processing your personal information after registration for a newsletter and approval by the user is Art. 6/1 lit. a GDPR.
The legal basis for processing your personal information after a previous booking or counselling is § 7/3 UWG.
c) Purpose of processing personal information
Asking for your email address is the only way of making sure you receive the wanted information. Asking for your name avoids misuse of the form or of the used email address.
d) Duration of storage
The personal information will be deleted as soon as they are not needed anymore for the reason of saving them. The email address of the user will be saved as long as the subscription persists.
Other personal information collected during the registration process will usually be deleted after a period of 7 days.
e) Revocation and deletion of personal information
The subscription of the newsletter can be revoked at any time. For this purpose each Newsletter has a link (Art 21/2 GDRP).
By using this link a deletion of all your personal information collected during registration process will be deleted as well.
7. Secure transfer of data
In case you contact us through the contact form or you register for a newsletter, all data will be transferred to us through a secure connection (SSL).

The print of our website's content, also excerpts, specially of images, needs the written approval of Sivali – Juergen Polte GbR.
